Modernista Privacy Policy

This Privacy Policy explains how Modernista ("Modernista," "we," "us," or "our") collects, uses, discloses, and protects information when you use the Modernista mobile application, website, emails, and related services (collectively, the "Service").

1. Scope

This policy applies to the Service and to information we process in connection with user accounts, styling preferences, looks, concierge messaging, subscriptions, virtual try-on, push notifications, support, and related app operations.

This policy does not apply to websites, services, or platforms we do not control, including app stores, device operating systems, payment processors, identity providers, or third-party sites linked from the Service.

2. Information We Collect

We collect information you provide, information created through your use of the Service, and limited technical information needed to operate and improve the Service.

Account and Profile Information

We may collect your name, email address, account identifiers, profile image, authentication information, onboarding status, subscription status, complimentary access status, and related account settings.

If you sign in using Apple or Google, we receive information made available by that provider, such as your name, email address, provider identifier, and authentication tokens needed to create or access your Modernista account.

Style, Preference, and Onboarding Information

We collect information you submit during onboarding and style-profile flows, such as fashion goals, favorite brands or designers, style preferences, fit preferences, preferred colors, budget range, occasions, wardrobe interests, and things you do not want recommended.

Photos, Images, Videos, and Attachments

You may upload profile photos, message attachments, look assets, and photos used for virtual try-on. These files may include images of your face, body, clothing, home, surroundings, or other personal information visible in the file.

For virtual try-on, we may process your uploaded photo, selected look images, validation metadata, generated try-on results, and related records such as processing status, timestamps, and error messages. We do not use face photos to identify you, create an identity profile, or authenticate you by face recognition. We process them to provide the requested try-on feature, validate photo quality, display your saved photos and generated results, and troubleshoot the feature.

Concierge Messages and User Content

We collect messages, attachments, feedback, and other content you send through concierge chat, support, profile, try-on, and look-interaction features. This may include text, images, videos, file metadata, read status, conversation status, and timestamps.

Looks, Favorites, and App Activity

We collect information about how you interact with looks and app features, such as favorited looks, free-look or free-try-on access, subscription entitlement checks, notification settings, and feature usage needed to provide your account experience.

Subscriptions, Purchases, and Access

If subscriptions or paid features are available, payment information is processed by the relevant app store or payment provider. We may receive and store purchase status, plan identifiers, subscription tier, expiration dates, cancellation status, complimentary access status, and related entitlement records. We do not intentionally store full credit card numbers in Modernista systems.

Device, Push Notification, and Technical Information

We may collect device and technical information such as device type, operating system, app version, Expo push tokens, platform, device identifiers used for notifications, crash or diagnostic information, log data, and timestamps. If you enable notifications, we use push tokens and notification preferences to send alerts such as concierge messages and newly published looks.

Communications and Support

If you contact us, we collect the information you provide, including your email address, message content, attachments, and any related support history.

3. Sensitive Information

Some information you provide may be considered sensitive under certain privacy laws, such as account credentials, photos that reveal your face or body, or styling information that could reveal personal characteristics.

We use sensitive information only for the purposes described in this policy, such as providing account access, virtual try-on, concierge styling, security, support, and legal compliance. We do not use sensitive information to infer characteristics beyond what is needed to provide the Service, and we do not sell sensitive information.

Service Providers

We use vendors that help us operate the Service. These may include hosting, database, storage, authentication, email, push notification, image generation, app delivery, diagnostics, payment, and customer support providers. These providers may process information only as needed to provide services to us and must protect information in a manner consistent with their obligations to us.

Concierge and Administrative Access

Authorized Modernista personnel and service providers may access account, profile, messaging, look, subscription, and support information when needed to provide concierge service, administer accounts, troubleshoot, moderate content, protect the Service, or respond to user requests.

Legal, Safety, and Compliance

We may disclose information if we believe it is necessary to comply with law, legal process, regulatory requests, enforce our terms, prevent fraud or abuse, investigate security issues, or protect the rights, safety, and property of Modernista, users, or others.

Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be disclosed or transferred as part of that transaction, subject to appropriate protections.

With Your Direction or Consent

We may disclose information when you ask us to, when you use features that share content, or when you otherwise consent.

6. Photos, Try-On Images, and AI Processing

Virtual try-on requires processing images you select or upload. To provide this feature, we may send the necessary photo and look image data to OpenAI or another image-generation provider. Generated images may be approximate, imperfect, or inaccurate and should not be treated as a guarantee of fit, appearance, size, color, availability, or suitability.

You should not upload photos or attachments that you do not have the right to use, that include other people without permission, or that contain sensitive information you do not want processed by the Service.

7. Retention

We keep information for as long as reasonably necessary to provide the Service, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business operations.

When we delete information, we may retain backups or logs for a limited period before they are overwritten or deleted in the ordinary course.

Depending on where you live, you may have the right to request access, correction, deletion, portability, restriction, or objection regarding your personal information. You may also have the right to appeal a privacy request decision.

You are responsible for keeping your account credentials and device secure and for notifying us if you believe your account has been compromised.

Modernista is offered internationally. Your information may be processed in the United States or other jurisdictions where we or our service providers operate. Privacy laws in those jurisdictions may differ from the laws where you live.

12. Changes to This Policy

We may update this policy from time to time. If we make material changes, we will provide notice as required by law, such as by updating the date above, posting notice in the app, or sending an email. Your continued use of the Service after the updated policy becomes effective means you acknowledge the updated policy.
